Unless the buyer and seller enter into a special confidentiality agreement, the exsistence, terms and conditions of the buyer’s offer or seller’s counter-offer are not confidential.
When a buyer makes an offer to purchase real property there is a possibility that the seller or seller’s representatives may not treat the existence, terms or conditions of the offer as confidential unless confidentiality is required by law, regulation, or by any confidentiality agreement between the parties. Likewise for a seller making a counter-offer there is a possibility that the buyer or buyer’s representatives may not treat the existence, terms or conditions of the counter-offer as confidential unless confidentiality is required by law, regulation or by any confidentiality agreement between the parties.
